ANC Free State PEC, several branches barred from attending elective conference

The High Court in Bloemfontein has barred several Free State branches from attending the national elective conference after the court nullified the party’s provincial conference. The High Court also ruled that the elective conference in Free State and its resolutions are unlawful and void. This means that the provincial executive committee (PEC) that was elected at that conference would not be able to attend the national conference in that capacity. The court has however allowed branches whose meetings were not in dispute to attend the conference. The Free State High Court ruling in favour of nullifying the recent ANC Provincial elective conference, has been met with mixed emotions. Attorney for the applicants, Hanno Bekker says the judgment delivered by the full bench of judges is one with a victory for both sides. The Provincial Elective Conference was declared illegal and its outcomes – which includes the newly elected Provincial Executive Committee – have been declared null and void. The Free State High Court will be handing down its judgment on #ANCvsANC today at 14:00. This comes after the opposing parties delivered their arguments in front of a full bench yesterday. Dali Mpofu, representing the applicants, argued that this past weekend’s ANC Provincial Elective Conference was unlawful, because the party did not adhere to the November 29th High Court ruling, which determined that 28 – not 29 – Branch General Meetings (BGMs) had to be rerun in a lawful manner per the ANC constitution. Mpofu argued that the ANC leadership in the Free State was therefore in contempt of court and the outcome of the conference should be nullified. […]

Judgment due in crucial ANC Free State case, on eve of national elective conference

Judgment is expected on Friday afternoon on whether the Free State’s more than 400 delegates will be interdicted from attending the ANC’s national conference. Four ANC members have taken the provincial executive committee (PEC) to court to have it and the province’s delegates barred from attending the conference. The highly anticipated conference starts on Saturday. A new president for the party is set to be elected in the coming days, with it mostly being a two-horse race between Deputy President Cyril Ramaphosa and Nkosazana Dlamini-Zuma.
